Question: Has the Riverton Bridge Kiosk Lease been leased yet?
Answer: The Mayor. I think we gave you that answer at the last Council meeting, is that the Council has engaged a Consultant and when the Consultant comes back to Council to give his/her recommendation, then that matter will come back to Council for a decision.
Question: What would be about the approximate time that Consultant will come back?
Answer: The Mayor. In October or November 2010.
Question: Did the Southern Metropolitan Regional Council (SMRC) place a Building Application with this Council to rebuild the Recycling Depot, which was burnt down?
Answer: The Mayor. That particular issue is before the State Administrative Tribunal (SAT), therefore I cannot give you any details on it.
Question: Question is, did they actually place an Application before this Council, it is either Yes or No?
Answer: The Mayor. It is not a matter of Yes or No, for the item, as you would know, to appear before the State Administrative Tribunal has to come through the Council.
Question: Why did it actually go to SAT, why didn’t this Council deal with it to start with? The application would have to come here, Mr Mayor. The opportunity was for this Council to vote on it.
Answer: The Mayor. Let me explain to you you ask the question and I am going to give you an answer. The Council has dealt with that item and the Proponent of the Application chose to go to the State Administrative Tribunal. The matter has now been taken out of the hands of the Council. What is your next question?
Question: Could you tell me how the Council dealt with that Motion?
Answer: The Mayor. It is on record.
Statement: I haven’t read the record; I am asking you, are you going to tell me?
Answer: The Mayor. The record is available and you can access it.

Answer: The Mayor You can ask as many times as you like, just finish asking your questions, I have given you an answer.
Question: The question is, why Council did not deal with it on the night?
Answer: The Mayor. Which night?
Question: When the application was before Council, why didn’t Council deal with it on the night and allow it to go to SAT?
Answer: The Mayor. Can you please tell me where you got that information from to start with, because obviously you are not aware what you are talking about, with all due respect, I do not know what you are talking about? I have explained to you how the process goes with this Council, you understand that?
Question: Yes I understand that.
Answer: The Mayor. Do you want me to explain it again. Next question please. Statement: No, I understand that. I am just trying to resolve this, I understand what you are saying.
Answer: The Mayor. We have already resolved it, I am asking you what is the next question?
Question: Was the application to build the Recycling Depot
Answer: The Mayor. You are not listening to me.
Statement: Yes I did, I just want to know yes or no.
Answer: The Mayor. I do not have to say yes or no. I explained to you the process by this Council and any other Council in Western Australia is going to go through the same process and that is what this Council has done. I have addressed that, do you have another question, if not, please sit down and I will call on someone else who may wish to ask a further question.

Answer: Acting Executive Strategic and Regulatory Services. The Southern Metropolitan Regional Council did not contact the City in relation to odour complaints that they received on 27 August 2010.

Question: Once again, I actually got a copy of the Local Government Act and actually rang the Department that looks at Planning Approvals and they said to me that nothing is really confidential other than the fact that when it goes to there. It is what is discussed between the Applicant and this Council that is confidential, but anything else in this Council is not confidential. With respect to that Mr Mayor, I ask again, when the SMRC put the Application to this Council to rebuild the Recycling Plant, which I quite sure this Council endorses recycling, and taking in mind that it was the Recycling Plant that was burnt down, not that the compost that was
allegedly causing all this smell in the area, but the Recycling Plant, I just wonder why the City of Canning choose to go behind closed doors, and I can’t find any minutes or why they went behind closed doors, or what happened behind closed doors, so obviously that is confidential, but why did the City of Canning , if it took legal advice to go behind closed doors on this, why did it choose to go behind closed doors and was there a recommendation from the Council Officers where the Applicant put the application to rebuild the Recycling Plant, which the SMRC have got all their money back from Insurance to rebuild it, I wonder why the City of Canning is,
in a sense, putting up a brick wall to try and stop this project from going ahead? Answer: The Mayor. Yes I can answer those questions and I will answer them in the same way as I did at the last Council meeting, because you did not understand what I told you. Obviously, whoever is informing you of what you are saying, they are completely wrong. You are talking about the SMRC, not quite sure what you are talking about, you are talking about SMRC who have got their Insurance money, I don’t know where you got that information from.
Statement: The Building Application was put in to rebuild the Recycling Plant.
Answer: The Mayor. Your questions are being recorded, so you can’t change it and I am answering your questions, if you listen and listen attentively, because I am not going to answer this same question at the next Council meeting. MRF at the SMRC burnt down on the 6 June 2008 and, sorry 2009. The SMRC put in a plan to rebuild that MRF. The application that came before this Council was not complete. The Council requested the Proponent to give further details in relation to that Application. As that information did not come forward before the 60 days, the SMRC has taken the matter to SAT means State Administrative Tribunal. Council had to go to the State Administrative Tribunal in order to respond to that claim. We went there and I can’t tell you what happened as it is
confidential. That is where the matter ends and I am not going to answer you at the next Council meeting.
Statement: With respect Mr Mayor, you gave me more information tonight that you did at the last Council meeting.
Answer: The Mayor. Whoever is informing you, you better tell them to give you the right information, or ask that person to ring me, or you can come in with him as well. I have nothing to hide.
Statement: Will take that on Board. I never said you did Mr Mayor, don’t infer that I did.
Question: Does the City of Canning support rebuilding, in principle
Answer: The Mayor. I already told you that I can’t answer that. That matter is before SAT and has been taken out of the City’s hands.
Question: I haven’t received a copy of my questions from last Council meeting and would like a copy sent to me.
Answer: The Mayor. If you give us a copy of your questions in writing, we will make every effort to give you as much information that we can possibly give you.
Statement: I just would like a copy of what was said between you and I at those meetings, prior to me being here tonight.
Answer: The Mayor. It is in our Agenda for the Council meeting.
Statement: I would like a hard copy that this City normally does send to me all previous questions I have ask at meetings.
Answer: The Mayor. If your questions were intelligible enough, and the Minute person could conduce as to what question you ask, then you will get what was written down.
