Nature of Interest: My daughter lives in the area affected by the odour.
Cr Elliott sought a ruling on his interest in this item of business on the grounds that his daughter lives in the area affected by the odour. Cr Elliott withdrew from the Council Chambers at 6.02pm.
MOVED Cr Barry, Seconded Cr Dowsett, that the interest declared by Cr Elliott in SRS-150-10 -
Odour Register – Regional Resource Recovery Centre – Canning Vale, is common to a significant number of electors or ratepayers.

CM-074-10 ATTENDANCE AT THE AUSTRALIAN LOCAL GOVERNMENT ASSOCIATION CONFERENCE AND THE THIRD AUSTRALIAN COUNCIL OF LOCAL GOVERNMENT MEETING

That:
(a) That report CM-074-10 Attendance at the Australian Local Government Association Conference and the Third Australian Council of Local Government Meeting be received.
(b) That approval be granted for the Mayor and Chief Executive Officer to attend the National General Assembly of Local Government on 14 to 17 June and the third Australian Council of Local Government Meeting on 18 June 2010 and costs to be charged to Account 20034 Conference Expenses and 46157 Staff Training.

CM-075-10 SOUTHERN METROPOLITAN REGIONAL COUNCIL – AMENDMENTS TO LICENCE

Amendment
Cr Barry suggested the following amendment.
MOVED Cr Barry, Seconded Cr Olsen, that:
(b) That the Council endorse the City of Canning’s Submission and approve the Appeal to the Minister for the Environment against the amended licence conditions issued to the Southern Metropolitan Regional Council for the operation of the Regional Resource Recovery Centre submitted by the Chief Executive Officer.
(c) That Council approve for the Mayor or Chief Executive officer to arrange a Deputation to the Hon Minister Donna Faragher, to acquaint her with the City’s position in relation to City of Canning’s Submission, with Mayor and the Chief Executive Officer attending along with any other interested Elected Members.
(d) That the City of Canning, on behalf of the Ratepayers/Residents forward a copy of its Submission on the amended Licence Conditions for the Waste Composting Facility operated by the Southern Metropolitan Regional Council to the Leader of the Opposition, the Shadow Minister for the Environment and all those Parliamentarians whose Electorate form in part or all in the City of Canning Boundary. Comments and questions followed by Cr Barry and the Mayor to the Chief Executive Officer.
Amendment
MOVED Cr Olsen, Seconded Cr Daly, that:
(e) Council endorse additional comments, by a secondary appeal to be submitted by the Chief Executive Officer, to the Environment Minister, that in particular the City of Canning requires that the original Licence Fire Management Section is retained in the new Licence.
(f) Council endorse that the Mayor and Chief Executive Officer obtain legal advice in regard to the fact that the original Licence Submissions that the Council received varies significantly from the final amended Licence.
(g) The City of Canning write to the DEC and request a report on submissions, objections and comments received in regard to the whole draft Licence Submission. Specifically the clause under Fire Management – Clause A2(a) “The Licence shall ensure that no waste is burnt on the Premises”. The City of Canning requests who made the amendments, when the amendments were made and on whose authority and why they were made. Further comments followed from Cr Olsen with Cr Clarke speaking against Cr Olsen’s amendment. The Mayor then requested Cr Clarke to retract his comments as they reflect adversely against the Council, Cr Clarke withdrew his comments.
Cr Daly then spoke for the Motion, with Cr Clarke raising a Point of Order that Cr Daly’s comments were reflecting adversely against him, Cr Daly then retracted and apologised for her comments. Questions followed by Cr Mason to the Mayor, with Cr Olsen closing the debate. The Mayor then put Cr Olsen’s amendment.

Against: Crs Clarke and Morgan
Following Cr Barry closing the debate, the Mayor put his amendment.
The Mayor then put the amended Motion, viz;
(a) That report CM-075-10 Southern Metropolitan Regional Council – Amendments to Licence be received.

Cr Olsen suggested the following amendment:
MOVED, Cr Olsen, Seconded Cr Daly, that:
(a) That Report SRS-150-10 is received.
(b) The City of Canning include in the Council Newspaper page, as soon as possible, an explanation and comment in regard to the letters the SMRC have listed on their web site from the Mayor¡¦s of Kwinana, Melville, East Fremantle, Rockingham and Fremantle and the Mayor of Cockburn.
(c) That a letter of explanation from the City of Canning be forwarded to the recipients that the above letters were sent to by the SMRC. The Mayor then suggested a new part (d) to the Motion, which was agreed to by the Mover and Seconder.
(d) that the Mayor of the City of Canning also write to the Mayors who are participants of the SMRC.
Following comment by Cr Olsen, the Mayor put the amended Motion, viz;
(a) That Report SRS-150-10 is received.
