Declaration of Interest
Cr Elliott SRS-241-10 – Odour Register – Regional Resource Recovery Centre – Canning Vale Nature of Interest: My daughter lives in the area affected by the odour.
Cr Elliott then sought a ruling on his interest in these items of business on the grounds that his daughter lives in the area affected by the odour and he lives near Fern Road. Cr Elliott withdrew from the Council Chambers at 6:08pm.
MOVED Cr Barry, Seconded Cr Wheaton, that the interest declared by Cr Elliott in SRS- 241-10 – Odour Register – Regional Resource Recovery Centre – Canning Vale is common to a significant number of electors or ratepayers.

5.2 QUESTIONS FROM THE PUBLIC GALLERY AT THE ORDINARY COUNCIL
Mr G W Gleeson,
Congratulations to the new Councillor, Mr Boylen and wish him luck. Also Mr Mayor, welcome back from your trip.
Question: Did Council pay for your trip or you?
Answer: The Mayor. The cost of the trip was approved by Council and is recorded in the Minutes.
Question: Will you be supplying a Business Case on your trip and will it be available to citizens of Canning?
Answer: The Mayor. Under the Code of Conduct, Members need to write a report outlining the details of Conferences or trip attended and it will be in the Minutes.
Question: I raised issues on the Riverton Bridge Kiosk/Café before headlines in the Newspaper. I note that a Business Broker has been appointed to interview lessees for the Café, how many original applicants applied for the lease before Business Broker was appointed.
Answer: Acting Chief Executive Officer. Previously Council considered a Confidential Report following advertising for a suitable lessee for the Café. Council resolved not to appoint any lessee and in order to attract a greater interest and increase number of applicants, appointed a Business Broker to assist in the process.
Question: Mr Mayor, can you explain to me, is the Weighbridge on the road reserve at Southern Metropolitan Regional Council (SMRC), is the road open to the public?
Answer: The Mayor. What I interpreted from your question is the weighbridge at the SMRC, in its current location accessible by the public?
Statement: Yes.
Answer: The Mayor. Access to the Weighbridge is through a gate, which is owned and placed in a particular location by the SMRC.
Question: Is Bridge location plan approved by the City true or false?
Answer: The Mayor. Council has not dealt with it. An on-going application and planning approval is required by the City.
Question: Did it need planning approval?
Answer: The Mayor. It requires planning approval.
Question: Supplement question is it prudent for Council in future to build bridges with the SMRC rather than to burn bridges ¡K
Answer: The Mayor. The Weighbridge is there to weigh trucks and for the appropriate charges to be applied.
Question: Mr Mayor, I will ask that question again is it prudent for Council in future to build bridges with the SMRC rather than to burn bridges over issues as there has been no complaints for a few months¡K
Answer: The Mayor. The City receives complaints everyday, I get them everyday by email. This Council has made the decision to depart from the SMRC and residents have benefited from withdrawing from the SMRC. The SMRC has stonewalled this Council for six years.

MOVED Cr Mason, Seconded Cr Barry, that the recommendation set out below, be adopted:
That:
(a) The Southern Metropolitan Regional Council be advised:
(i) that Council does not agree to appoint Mr John Harvey of Australian Valuation Partners to solely determine market value for the rent review as at 12 May, 2010.
(ii) Council appoints Mr Philippe Putigny of Landgate Valuation Services as its valuer for the determination of market value for the required rent review with the Southern Metropolitan Regional Council’s appointed valuer Mr John Harvey.
(b) Mr Putigny of Landgate Valuation Services be notified of a) and b) above,
