Cr Barry ET-139-10 – Bentley East – State Underground Power Program Steering Committee Approval With regard to the matter listed above, I disclose that I have an association with Bentley East Underground Power Program. As a consequence, there may be a perception that my impartiality on the matter may be affected. I declare that I will consider this matter on its merits and vote accordingly.
Nature of Interest: I have extended family who live in the area.

Cr Elliott then sought a ruling on his interest in this item on the grounds that his daughter lives in the area affected by the odour.
Cr Elliott withdrew from the Council Chambers at 6.08pm.

5.1 QUESTIONS FROM THE PUBLIC GALLERY AT THE ORDINARY COUNCIL MEETING ON 28 SEPTEMBER 2010

Question: Once again, I actually got a copy of the Local Government Act and actually rang the Department that looks at Planning Approvals and they said to me that nothing is really confidential other than the fact that when it goes to there. It is what is discussed between the Applicant and this Council that is confidential, but anything else in this Council is not confidential. With respect to that Mr Mayor, I ask again, when the SMRC put the Application to this Council to rebuild the Recycling Plant, which I quite sure this Council endorses recycling, and taking in mind that it was the Recycling Plant that was burnt down, not that the compost that was allegedly causing all this smell in the area, but the Recycling Plant, I just wonder why the City of Canning choose to go behind closed doors, and I can’t find any minutes or why they went behind closed doors, or what happened behind closed doors, so obviously that is confidential, but why did the City of Canning , if it took legal advice to go behind closed doors on this, why did it choose to go behind closed doors and was there a recommendation from the Council Officers where the Applicant put the application to rebuild the Recycling Plant, which the SMRC have got all their money back from Insurance to rebuild it, I wonder why the City of Canning is, in a sense, putting up a brick wall to try and stop this project from going ahead?
Answer: The Mayor. Yes I can answer those questions and I will answer them in the same way as I did at the last Council meeting, because you did not understand what I told you. Obviously, whoever is informing you of what you are saying, they are completely wrong. You are talking about the SMRC, not quite sure what you are talking about, you are talking about SMRC who have got their Insurance money, I don’t know where you got that information from.
Statement: The Building Application was put in to rebuild the Recycling Plant.
Answer: The Mayor. Your questions are being recorded, so you can’t change it and I am answering your questions, if you listen and listen attentively, because I am not going to answer this same question at the next Council meeting. MRF at the SMRC burnt down on the 6 June 2008 and, sorry 2009. The SMRC put in a plan to rebuild that MRF. The application that came before this Council was not complete. The Council requested the Proponent to give further details in relation to that Application. As that information did not come forward before the 60 days, the SMRC has taken the matter to SAT – means State Administrative Tribunal. Council had to go to the State Administrative Tribunal in order to respond to that claim. We went there and I can’t tell you what happened as it is confidential. That is where the matter ends and I am not going to answer you at the next Council meeting.
Statement: With respect Mr Mayor, you gave me more information tonight that you did at the last Council meeting.
Answer: The Mayor. Whoever is informing you, you better tell them to give you the right information, or ask that person to ring me, or you can come in with him as well. I have nothing to hide.
Statement: Will take that on Board. I never said you did Mr Mayor, don’t infer that I did.
Question: Does the City of Canning support rebuilding, in principle
Answer: The Mayor. I already told you that I can’t answer that. That matter is before SAT and has been taken out of the City’s hands.
Question: I haven’t received a copy of my questions from last Council meeting and would like a copy sent to me.
Answer: The Mayor. If you give us a copy of your questions in writing, we will make every effort to give you as much information that we can possibly give you.
Statement: I just would like a copy of what was said between you and I at those meetings, prior to me being here tonight.
Answer: The Mayor. It is in our Agenda for the Council meeting.
Statement: I would like a hard copy that this City normally does send to me all previous questions I have ask at meetings.
Answer: The Mayor. If your questions were intelligible enough, and the Minute person could conduce as to what question you ask, then you will get what was written down.

CM-126-10 OUTSTANDING BUISINESS FROM COUNCIL MEETINGS
Question: Executive Finance and Client Services then took on Notice Cr Barry’s query in relation to the EFT payment for $509,236.43 and the breakdown of costs for this payment.
Answer: Executive Finance and Client Services.
The above amount relates to the City’s loan repayment to the Southern Metropolitan Regional Council (SMRC) for the September 2010 Quarter.
It represents the City’s portion of the amount of $1,683,751.84 payable by the SMRC for the Regional Resource Recovery Facility (RRRC) and Office Accommodation loan payment due to the Western Australian Treasury Corporation.
The above amount is represented as follows:
Capital Repayment $ 847,025.49
Interest Payment $ 824,183.63
Guarantee Fee $ 12,542.72
Total $1,683,751.84
This amount has been recovered by the SMRC from the existing member Councils and the City of Canning based on the establishment agreement. The City has contributed $509,236.43 (GST inclusive) to the payment made by the SMRC to the Western Australian Treasury Corporation.
The City’s 2010/2011 Annual Budget has made provision of $1,907,793 as compared to the amount of $1,589,670 for the 2009/2010 Budget allocation.
A detailed review of loan movements over the lifetime of the loans is being undertaken in preparation for finalising the financial aspects of the City’s withdrawal from the SMRC. This will be further commented on at the confidential briefing to be held on 11PthP October 2010.

13.1 CHIEF EXECUTIVE OFFICER
Cr Barry: Firstly, my question relates to a Notice of Motion that I had on 13 October 2009 which was in relation to letters to be sent to Ministers and Parliamentarians. The agenda refers to 11 May which says that it was 99% through. It was stated letters had been sent to Ministers and Parliamentarians. I would assume that it is 100% by now but I have no recollection of this coming before Council. Could the CEO please investigate and provide Members with a copy of letters to Ministers and/or Parliamentarians.
On 27 January 2010, page 26, in relation to Odour Register, it refers to a working group being formed with the Mayor, Cr Olsen and CEO. First meeting of the Working Group to be held subject to the availability of Members. Has there been a meeting held subsequent to the formation of this working group?
Mayor: The Mayor advised, due to a heavy workload, that at this point in time there has been no meeting held.
Cr Barry: In relation to SRS-149-10, page 30, the Strategic Planning West Welshpool Precinct Update, it was stated that a Report would be presented to Council in November 2010. A report from TPG was finalised in June of last year and the City has been in possession of this since August. Could an answer be given as to why the evaluation has not taken place, prior to any stakeholder consultation?
Mayor: This will be taken on notice.
Cr Barry: I refer to the Relocation of Local Planning Policy. This goes back to 8 June. At that time I asked for public consultation and was told this was being initiated. The Planning Policy would be in relation to the public itself because the relocation, unless it was an individual, would be the only people who would be involved. Surely just a public notice in the paper would be sufficient enough to move on this matter.
Mayor: This will be taken on notice.
