4. DECLARATION OF MEMBERS’ AND OFFICERS’ INTERESTS
Declaration of Interest
Cr Elliott PD-111-11 – Odour Register – Regional Resource Recovery Centre – Canning Vale Nature of Interest: My daughter lives in the area affected by the odour.
Cr Elliott sought a ruling on his interest on the above items of business on the grounds that his daughter lives in the area affected by the odour. Cr Elliott withdrew from the Council Chambers at 6.02pm.
MOVED Cr Barry, Seconded Cr Morgan, that the interest declared by Cr Elliott in item PD-111-11 – Odour Register – Regional Resource Recovery Centre – Canning Vale is common to a significant number of electors or ratepayers.
CARRIED UNANIMOUSLY
For: The Mayor, Crs Barry, Mason, Clarke, Dowsett, Wheaton, Morgan and Boylen
Cr Elliott returned to his chair at 6.03pm and was informed of Council’s decision.
Cr Olsen entered the Council Chambers at 6.03pm.

11. MOTIONS OF WHICH PREVIOUS NOTICE HAS BEEN GIVEN

MOVED Cr Olsen, Seconded Cr Mason that:
1. The Chief Executive Officer prepares a report to Council to address the potential of Noxious Industries and any other future Industries or Businesses, that apply to operate in the City of Canning, that could potentially produce odour or nuisances to the Community, procedures so that all applications are to come before Council for due consideration and diligence, before development approval can be given.
2. Also for procedures to be in place, so that appropriate staff would not overlook these applications and that they are to be bought to Council as per this motion.
3. This report is bought back to Council within two months.

MOVED Cr Olsen, Seconded Cr Wheaton that:
1. A report is presented to Council into the recent and past odour problems from Kailis Bros Fish Factory located in Canning Vale.
2. A report is presented to Council in regard to the compliance of the above of Kailis Bros, the current regulations that are in place, and the steps being taken to enforce action if any is necessary.
3. Both these reports are to be bought back to Council within one month.

Cr Olsen provided the following amendment with an additional part (b):

“(b) The Mayor, CEO contact the DEC, Minister for Environment, Minister for Health and any other relevant person they consider necessary, to raise again concerns and to complain about the continuing odour emanating from the SMRC’s RRRC and the continued lack of compliance from this facility.” The Mayor put the amendment.

Following lengthy comment from Cr Olsen, providing information on the personal impact on residents of continued exposure to odour. The Mayor put the amended motion, viz:
That:
(a) Report PD-111-11 Odour Register – Regional Resource Recovery Centre, Canning Vale, be received.
(b) The Mayor, CEO contact the DEC, Minister for Environment, Minister for Health and any other relevant person they consider necessary, to raise again concerns and to complain about the continuing odour emanating from the SMRC’s RRRC and the continued lack of compliance from this facility.
